    Terms of Service:

    HUSSAINI ASSOCIATION OF CALGARY Sunday School Program – Comprehensive Liability Waiver, Release, and Indemnification Agreement

    This Agreement is entered into by the undersigned parent or legal guardian (“Parent/Guardian”) of the minor child named below (“Participant”), in favor of the Hussaini Association of Calgary, a registered non-profit religious organization, in connection with the Participant’s enrollment and participation in the Hussaini Calgary Sunday School (“Program”).

    1. Voluntary Participation and Assumption of Risk
    The Parent/Guardian acknowledges that participation in the Program is entirely voluntary and that the Participant may engage in a variety of activities, including but not limited to classroom instruction, religious education, group discussions, recreational activities, arts and crafts, and community service projects. The Parent/Guardian understands that these activities may involve physical exertion, interaction with other participants, and use of facilities and equipment.

    The Parent/Guardian expressly assumes all risks associated with the Participant’s involvement in the Program, including but not limited to:

    Minor injuries such as cuts, bruises, sprains, or strains; Serious injuries such as fractures, concussions, or other trauma; Exposure to allergens, communicable diseases, or environmental hazards; Emotional or psychological stress; Accidents occurring on Program premises or during off-site events.

    2. Waiver and Release of Liability
    To the fullest extent permitted by applicable law, the Parent/Guardian hereby irrevocably and unconditionally waives, releases, and discharges the Hussaini Association of Calgary, its directors, officers, employees, contractors, volunteers, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to any injury, illness, death, or property damage sustained by the Participant in connection with the Program.

    This release applies regardless of whether such injury or damage is caused by the negligence, active or passive, of the Released Parties, and includes claims for:

    Medical expenses; Pain and suffering; Emotional distress; Loss of consortium; Wrongful death; Any other direct or indirect damages.

    3. First Aid and Emergency Medical Treatment Authorization
    The Parent/Guardian acknowledges that the Program staff and volunteers are not licensed medical professionals and may only provide limited first aid assistance. Nevertheless, the Parent/Guardian hereby authorizes the Released Parties to:

    Administer basic first aid to the Participant as deemed necessary; Contact emergency medical services (EMS) and/or transport the Participant to a medical facility if, in their sole discretion, such action is warranted; Share relevant medical information with emergency responders and healthcare providers; Make decisions regarding the Participant’s medical care in the event the Parent/Guardian cannot be reached.
    The Parent/Guardian agrees to be solely and fully responsible for all costs and expenses incurred in connection with any medical treatment, including but not limited to:

    Ambulance services; Emergency room visits; Hospitalization; Physician fees; Medications; Follow-up care.
    The Parent/Guardian further agrees not to hold the Released Parties liable for any decisions made in good faith regarding the provision or withholding of medical care.

    4. Indemnification
    The Parent/Guardian agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

    The Participant’s participation in the Program; Any breach of this Agreement; Any negligent or intentional act or omission by the Participant; Any claim brought by or on behalf of the Participant or any third party. 5.

    5. Code of Conduct and Dismissal Policy
    The Parent/Guardian acknowledges that the Participant is expected to adhere to the Program’s code of conduct, which includes respectful behavior, cooperation with staff and volunteers, and compliance with safety rules. The Hussaini Association of Calgary reserves the right to dismiss any Participant from the Program, temporarily or permanently, for behavior deemed inappropriate, disruptive, or unsafe, at its sole discretion. No refund or compensation shall be provided in such cases.

    6. Governing Law and Jurisdiction
    This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.

    7. Severability
    If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

    8. Entire Agreement
    This Agreement constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
